Welcome to youSleep.ai, a platform for the analysis of sleep recordings designed for research and non-clinical commercial purposes (subject to the licences of the individual analyses, refer to our license details). These Terms and Conditions govern your access to and use of our services, provided through:

By accessing or using our services, you agree to be bound by these terms. Please read them carefully before proceeding.

1. Non-Medical Nature of the Service

The services provided by youSleep.ai are strictly for informational purposes, research purposes, or non-clinical commercial purposes (depending on the license applied to the analyses). The services are not designed or intended to be used as a medical device or for any clinical purposes.

The results generated by our algorithms or models are for informational purposes only and do not constitute medical advice, diagnosis, or treatment. Users acknowledge that the service should not be relied upon for making clinical decisions or providing healthcare services.

1.3 User Responsibility

We do not take responsibility for any errors, inaccuracies, or misinterpretations of the data produced by these models.

3.2 Changes and Updates
We reserve the right to modify or discontinue the service, its features, and limitations at any time without prior notice. This may include changes to data storage limits, analysis capabilities, or account features.

4. Data Upload, Storage, and Retention
4.1 Data Upload
Users may upload sleep recordings and other relevant data for analysis using our platform. You are responsible for ensuring that any uploaded data complies with our guidelines and terms, including anonymizing personal information as needed.

4.2 Storage of Data
The data you upload will be stored locally on our platform for the purpose of analysis, but the platform is not intended to be a file storage service. You will not have the ability to download uploaded files after they have been uploaded to the platform.

4.3 Data Deletion
We may delete any uploaded data at any time, especially if it is necessary to comply with legal obligations, maintain system performance, or if data exceeds the storage limits associated with your account. While we try to avoid deleting data unexpectedly, we make no guarantees regarding the retention of uploaded files.

5. Intellectual Property Rights
5.1 Ownership
All content, algorithms, models, software, and services provided by youSleep.ai are the exclusive property of youSleep.ai and its licensors. By using the service, you do not gain any ownership rights to the underlying technology or intellectual property of the platform.

5.2 License to Use
Subject to these terms, youSleep.ai grants you a limited, non-exclusive, non-transferable license to use the services for the permitted purposes (research or non-clinical commercial use, depending on your account). Any other use, reproduction, or modification of the service or its content is prohibited unless explicitly authorized.

6. Disclaimer of Warranties
6.1 As-Is Basis
The service is provided on an "as-is" and "as-available" basis, without warranties of any kind, either express or implied, including, but not limited to, implied warranties of fitness for a particular purpose, non-infringement, and merchantability.

We do not guarantee that the service will be uninterrupted, error-free, or secure at all times. We may experience technical issues, maintenance interruptions, or other delays that can affect access to the service.

7. Limitation of Liability

youSleep.ai takes no responsibility for errors or inaccuracies in the results of the analyses provided by the models or algorithms on the platform. The service is intended solely for informational purposes, and any decisions based on the results are made at your own risk.

8. Account Termination
8.1 Termination by User
You may terminate your account at any time by following the account deletion process on the platform. Once your account is terminated, any uploaded data may be permanently deleted, and access to the service will be revoked.

8.2 Termination by YouSleep.ai
We reserve the right to suspend or terminate your account at any time, for any reason, including, but not limited to, violations of these Terms and Conditions or improper use of the platform.

9. Changes to These Terms
YouSleep.ai reserves the right to modify or update these Terms and Conditions at any time. Any changes will be posted on this page with the "Version" & "Valid from" tags revised. Continued use of the service after any changes constitute your acceptance of the new Terms and Conditions.

10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved in the courts of Denmark.

Terms and Conditions Amendment: Closed BETA Program Registration

This amendment applies specifically to users participating in the closed BETA program of the youSleep.ai portal. By registering for the closed BETA program, you agree to the following additional terms and conditions, which are subject to the overarching Terms and Conditions of Service.

1. BETA Program Instability
1.1 Potential Instability
During the closed BETA phase, the service may be more unstable than usual as we continue to develop and improve the portal. Participants may experience unexpected bugs, service disruptions, or temporary unavailability of certain features. We appreciate your patience as we work to resolve these issues.

2. Restrictions on File Uploads
2.1 Limited File Uploads
BETA users are restricted to uploading small files and limited numbers of files. These limits are in place to ensure optimal performance during the testing phase and may change at our discretion as we monitor system capacity and performance.

3. Regular Service Updates
3.1 Frequent Updates
The databases and backend systems of the portal will be regularly updated throughout the BETA period. These updates are necessary for improving the service but may result in sudden, unannounced service interruptions and possible deletion of user accounts and data.

3.2 No Guarantees on Data Retention
We will strive to avoid data loss, but during this BETA phase, youSleep.ai makes no guarantees regarding the retention or integrity of uploaded data or user accounts. Any data uploaded to the portal during the BETA may be deleted without notice during routine system updates or maintenance.

4. Account and Data Recreation
4.1 Efforts to Recreate User State
In the event that your account or data is deleted due to a system update, we will strive to recreate your account and user state to the best of our ability. However, we do not guarantee the full recovery of all data or previous settings.

4.2 Re-Signing Up with BETA Key
If your account is deleted during an update, you will be able to re-sign up using your BETA key. This key will allow you to restore your access to the portal and continue participating in the BETA program.

5. General BETA Terms
